Motus Handling attaches great importance to your privacy. As the controller of your personal data, Motus Handling, together with the Valtech Group (co-controller), has taken various measures to protect your personal data as well as possible. In accordance with the General Data Protection Regulation and the Belgian Privacy Act, you will find in this privacy statement all information about how we safeguard the privacy of candidates, customers, suppliers, and other contracting parties or people we contact.

This privacy statement applies to the site and all services of Motus Handling and the Valtech Group. This statement does not cover the privacy policy of other websites referred to via hyperlinks on the Motus Handling or Valtech Group site and for which they are not responsible.

The Valtech Group includes various companies: Valvan Baling Systems, Ad Rem, Rentec, Motus Handling (Menen and Roeselare divisions), Gualchierani Baling Systems, Cretes, Vaskon (Menen and Oudenaarde divisions), Valvan Containers & Milieutechniek, Union, Allhydro, Haeck Subcontracting and SedActa. Privacy is important for each of these companies, and protection of your data is provided in the same way. Personal data means all specific information relating to an identifiable natural person.

With regard to applications received by the Valtech Group, we collect, among others, the following personal data: name, first name, age/date of birth, gender, marital status, nationality, email address, telephone and/or mobile number, address, fields of study, schools, diplomas and training, (desired) function, career, current employer, language skills, contact preference, additional information we receive from you... This includes all personal data provided in the context of an application procedure (job interviews, selection tests and competency or other tests).

For the preparation and/or execution of contracts that the Valtech Group concludes with prospects, customers and suppliers (contracting parties), we keep identification data, address, contact persons and financial data.

  1. How is data collected?

We collect data from candidates, prospects and contracting parties (e.g. customers or suppliers) primarily by receiving this data from the person themselves. Furthermore, we can also obtain this data via third parties (e.g. selection or temporary employment agencies), via online or offline media (e.g. public networks such as LinkedIn) or via partners.

  1. Processing purposes and bases

The data collected by the Valtech Group is only the data necessary for the purposes for which this data was collected.

The processing of applicant data is in the legitimate interest of the Valtech Group. This legitimate interest consists of guaranteeing the proper functioning of the company on the one hand, and maintaining and expanding the business operations of the Valtech Group on the other.

The processing of data of contracting parties is necessary to execute the concluded agreement as well as possible. It is also possible that we use this data for marketing. The use of this data for direct marketing is in the legitimate interest of the Valtech Group. This legitimate interest consists of maintaining and expanding the business operations of the Valtech Group.

The processing of prospect data is justified based on the legitimate interest of the Valtech Group (including direct marketing). This legitimate interest consists of maintaining and expanding the business operations of the Valtech Group.

Where necessary and in accordance with legislation and regulations, we will always ask for consent to process the data.

  1. With whom do we share personal data?

The Valtech Group receives applicant data via the job site (www.jobs.valtechgroup.eu) or via hr@valtechgroup.eu. All respective applications of the companies under the Valtech Group arrive at this central point and are delivered to the company in question. If the candidate's profile fits within multiple companies of the Valtech Group, this candidate can also be presented to other companies of the group. However, the management of incoming applications always happens centrally at the level of the Valtech Group.

For the central management of applications, the Valtech Group uses a processor (as long as necessary). However, the processor always and only processes the personal data of the Valtech Group for the purposes as described in this privacy statement. The processor does not use this data for other purposes that are not in the interest of the Valtech Group (e.g. enrichment of the processor's own database).

Also within the Valtech Group, data of applicants, prospects, customers and suppliers can be transferred or accessible to overarching services of the Valtech Group (e.g. HR, marketing, spare parts service, accounting, IT, purchasing and sales). The Valtech Group ensures that the data is only accessible to group employees who need this for the performance of their job.

It is also possible that the Valtech Group shares data with third parties such as service providers who perform functions on our behalf (including external consultants, business partners and professional advisors) or outsourced IT providers and document storage providers with whom we have an appropriate processing agreement (or similar protection constructions).

  1. How long do we keep personal data?

We keep your personal data for the period necessary in light of the above-mentioned purposes.

  • We keep applicant data up to five years after the presentation of or the last contact with the applicant.
  • We keep data of prospects, customers and suppliers as long as necessary to guarantee the proper business operations of the Valtech Group. This is necessary to, among other things, guarantee appropriate after-sales services and further develop customer relationships. In any case, the Valtech Group deletes the data of prospects, customers and suppliers if they explicitly request this.
  1. Rights of Users

If we process personal data, the data subject has various rights. The data subject can always contact Valtech Group for this via privacy@valtechgroup.eu. We do our best to comply with requests as quickly as possible and in any case within the period and conditions as imposed by the regulations. This period is usually one month, but can be extended under certain (legal) conditions.

It is possible that we keep a record of our communication with you to help us solve any problems you report.

It is important that the personal information we have about you is correct and up to date. You may always inform us of changes during the period we keep your data.

  1. Right to restriction of and objection to processing

You can object to the processing of your personal data when we base this processing on our legitimate interests or when we send you direct marketing materials. If you invoke this right, we will stop our activities. If we base the processing on our legitimate interests, we can only continue the processing if:

  • we can demonstrate that we have compelling, legitimate grounds for the processing that override your interests;
  • we process your data to formulate, execute or defend a legal claim.

You can also invoke the right to restriction of processing. This means that we can only continue to store your data, but cannot do any further processing:

  • until the accuracy of the personal data has been verified.
  • if you object to the deletion of your data, but the processing is unlawful.
  • until it is clarified whether the legitimate grounds of the Valtech Group outweigh yours if you have objected to the processing.
  1. Right to data portability

You have the right to transfer your personal data between controllers. You receive the data in a common and machine-readable form. You can exercise this right if the following conditions are met:

  • It concerns personal data provided by you.
  • The processing is based on your consent or the execution of an agreement.
  • The processing was done in an automated way (not just paper).
  • The transfer does not harm the rights and freedoms of others.
  1. Right to withdraw consent

When you have given us permission to process your personal data for certain activities, you can withdraw this consent at any time. In this case, we will stop the activity for which you had given your consent. Only if the Valtech Group believes there is an alternative ground to justify a continuation of the processing of your data for this purpose will we not stop the processing. If this is the case, we will inform you about it.

  1. Right to erasure

Under certain circumstances, you can request the Valtech Group to erase your personal data, namely when:

  • the personal data are no longer necessary for the purposes for which they were collected or processed;
  • you withdraw your consent for the processing and this processing is not based on another legal ground;
  • the personal data have been unlawfully processed;
  • it is necessary to delete the personal data to comply with legal obligations as a controller;
  • the Valtech Group processes the data because we consider this necessary for our legitimate interests, you object to this processing and the Valtech Group is unable to demonstrate more compelling legitimate grounds.
  1. Right of access and rectification

You can ask us at any time what information we keep about you. In addition, you can ask to supplement and correct this information.

It is possible that we ask you to verify your identity. We will not charge for your access unless your request is manifestly unfounded or excessive. Also if you ask us for extra copies of this information, we can charge you reasonable administrative costs if this is legally allowed.

Under certain circumstances, it is possible that we reject your request. If we reject your request, we will always explain why we do this.

  1. Right to lodge a complaint with the Data Protection Authority

If you believe that the Valtech Group does not correctly comply with privacy regulations, you have the right to lodge a complaint with the local supervisory authority, namely the Belgian Data Protection Authority.

The Valtech Group takes all reasonable and appropriate steps to protect the integrity, confidentiality and availability of the personal information we have against misuse, loss or unauthorized access. We have taken both technical and organizational measures for this. The Valtech Group and its employees respect the privacy of all data subjects and keep the data confidential.
